Abstract
Prof. Nard states that the Federal Circuit has been criticized for its insularity and “inadequately nuanced jurisprudence.” He asserts that if the Federal Circuit had a peer court and a “sister-circuit jurisprudence” it would have meaningful impact on the appellate strategy for patent law cases.
